"The reason we had judicial review is because Congress didn't stop them."
-Tom DeLay, Constitutional scholar
Damn you, Chief Justice John Marshall!

Congress can alter the scope of Article III jurisdiction simply by confirming judges who in fact "alter" said scope and/or the formal Amendment Process. I think taking away some jurisdictional powers not included under Art. III would help too. Not to mention a couple impeachment proceedings. If Congress won't do any of that, it just may be time for another revolution.
I'm just afraid not enough people know their Federalist Papers anymore. Since your side is convinced judicial activism is O.K., I fail to see how you can complain when we simply want some of the same action - maybe now you can finally grasp the slippery slope we've been pointing out all along? Once and for all, we are either going to have judicial activism, or not. LOL, Charlie

I've heard all of that nonsense before. BTW, did you know that Republican appointees dominate the federal judiciary?

Glad to keep you laughing - I have heard there are lots of Republican appointees - if you can call Kennedy and O'Connor "Republican" anymore. Just be careful what you wish for in terms of "judicial activism".
