Judicial activism is the least of my wories, Oscar

I'm as allergic to hearing "judicial activism" as I am to" moral clarity" and "ethical policy." Content-free code words that are in the mind of the beholder.
I'd rather say, "a government of laws not of lawyers". We've had a lot of nice lawyering about how to get around the letter of the law, but adherence to the spirit of the law has been less frequently evidenced.
See today's opinion from Judge Green. I think we're about to see an "activist" SCOTUS hold the Ashcroft Justice Dept accountable -- especially in the aftermath of having been lied to by the gov't in the previous detention cases.
