I certainly agree about the over used phrases you cite; and many more on Left and Right as well. Slogans and sound bites do not make for useful discussion. My problem was with the strategy of using them against Bush in the Gonzales matter. Democrats do not seem to be well served by the elected Congresscritters they still have at the moment. The Rice hearings made Boxer and Kerry look silly, and the picture of the Teddy on his high horse is enough to make me ill. Rather a policy of thoughtful dissent, unattached to infighting, seems more useful. Two people who used this sort of thing to good effect were Gene McCarthy and Moynihan, but it requires a more aikido style mind than most in our current Congress seem to have.
A constant low key refrain of "government of laws not of men" might be successful, particularly now that the Democratic party has rediscovered the values of states rights and the electoral college. But beware of the negative effects from too much judicial activism - which is a clear cut case of" government of lawyers, not of men."
